Capitalized terms used in this Privacy Policy but not defined herein have the meanings assigned to them in the Mobility Stock Terms & Conditions. Mobility Stock is responsible, as the business, controller, or equivalent under applicable law, for the personal information it collects and processes through the Platform as described in this Privacy Policy.
To operate the Platform and provide requested products and services, Mobility Stock may disclose or make personal information available to third parties, including Participating Stores, payment processors, shipping and delivery providers, Manufacturers, service providers, and other parties described in this Privacy Policy.
When personal information is provided to a Participating Store in connection with an Order, Rental Reservation, Service Request, warranty claim, return, refund, delivery, installation, repair, maintenance, or other requested product or service, that Participating Store is an independent business and is separately responsible, as its own business or controller, for the collection, use, storage, protection, and other processing of the personal information it receives, in accordance with applicable law and its own privacy practices.
Mobility Stock is not responsible for the independent privacy practices of a Participating Store, a Manufacturer, or another third party with respect to personal information processed outside Mobility Stock's control.
Mobility Stock is not a health care provider, health plan, or health care clearinghouse, and does not act as a covered entity under the Health Insurance Portability and Accountability Act ("HIPAA"). A Participating Store that is a HIPAA covered entity remains responsible for its own obligations under HIPAA and other applicable health information laws.

The personal information Mobility Stock collects depends on how you interact with the Platform and the products, services, and functionality you choose to use.

Mobility Stock does not receive or store complete payment card numbers, card verification values (CVV/CVC), or other sensitive payment credentials. Payment information is processed by third-party payment service providers.
Many Products offered through the Platform are mobility and medical products. Information about the Products you view, search for, or purchase, and the delivery, installation, or service requests you submit, may suggest something about your health or a physical condition.
Mobility Stock does not request, and asks that you not submit through the Platform, diagnoses, medical records, prescriptions, insurance identification numbers, Social Security numbers, or other health or government identification information.
Prescription devices, which federal law restricts to sale by or on the order of a licensed practitioner, are not offered or sold through the Platform. See Section 5.11 of the Terms & Conditions. Where a Participating Store sells or rents such a Product directly, outside the Platform, the prescription or practitioner order is provided to that Participating Store and is not submitted to or retained by Mobility Stock.
Mobility Stock does not use or disclose information that reveals a Customer's health condition for the purpose of inferring characteristics about that Customer, and does not use that information for targeted advertising or sell it, except with the Customer's consent where consent is required or otherwise as permitted by applicable law.
The following table describes the categories of personal information Mobility Stock has collected through the Platform within the preceding twelve (12) months, examples of each category, and the categories of third parties to which that information may be disclosed for a business purpose. Mobility Stock does not collect or process personal information for the purpose of profiling in furtherance of decisions that produce legal or similarly significant effects concerning a Customer.
Mobility Stock uses personal information for legitimate business purposes related to operating, maintaining, improving, and protecting the Platform and facilitating the products and services available through it.

Where permitted by applicable law, Mobility Stock may use your contact information to send promotional or marketing communications regarding products, services, educational content, newsletters, special offers, promotions, and other information that may be of interest to you.
You may opt out of receiving promotional or marketing communications at any time by following the unsubscribe instructions included in those communications or by updating your communication preferences where available.
Opting out of promotional or marketing communications does not affect transactional, account, security, or service-related communications that are necessary to operate the Platform, complete or administer transactions, provide requested products or services, or otherwise respond to your requests.
Where you provide a telephone number, Mobility Stock or the applicable Participating Store may contact you by telephone or text message regarding your Order, Rental Reservation, Service Request, delivery, or other transaction. Message and data rates may apply. Consent to receive marketing calls or text messages is not a condition of any purchase, and you may opt out at any time by replying STOP to a text message or by contacting us.
Mobility Stock and certain Participating Stores may use call-tracking, call-recording, chat, or session-recording technologies. Where Mobility Stock controls the recording of a call or other communication, Mobility Stock will provide any notice and obtain any consent required by applicable law before the communication is recorded. A Participating Store that uses its own call-tracking, call-recording, or similar service is responsible for configuring and using that service, including providing required notices and obtaining required consent, in accordance with applicable law. Mobility Stock does not sell personal information for money.
Some state privacy laws define a "sale" or "sharing" of personal information broadly enough to include the use of certain advertising, analytics, or measurement technologies that make information available to third parties. Where those technologies are used on the Platform, you may opt out as described in Section 8.
Mobility Stock may disclose or make personal information available to third parties when reasonably necessary to operate the Platform, facilitate transactions, provide requested products or services, comply with legal obligations, protect the Platform and its users, or for other purposes described in this Privacy Policy.

When you purchase a Product or request a Rental Reservation, repair, maintenance, installation, warranty service, delivery, pickup, or other product or service offered or fulfilled by a Participating Store, Mobility Stock may provide that Participating Store with the personal information reasonably necessary to facilitate and fulfill the applicable transaction or request.
Depending on the transaction or service, this information may include contact information, delivery or service information, Order, Rental Reservation, or Service Request information, and other information reasonably necessary for the Participating Store to provide the requested product or service.<?p ?>
Mobility Stock does not provide a Participating Store with the personal information of Customers who have not transacted with, or submitted a request to, that Participating Store.
The Participating Store is independently responsible for the personal information it receives and processes, in accordance with applicable law and its own privacy practices. Participating Stores are required by their agreements with Mobility Stock to use Customer personal information only as necessary to fulfill Platform transactions and to comply with applicable law.
Mobility Stock may disclose or make personal information available to third-party service providers that assist us in operating, maintaining, securing, and supporting the Platform or in facilitating requested products, services, and transactions.

These service providers may receive or process personal information only as reasonably necessary to perform the services for which they have been engaged, subject to applicable law and their contracts with Mobility Stock.
Where reasonably necessary to address a warranty request, Product Recall, replacement part, technical support request, or other Manufacturer- or supplier-supported matter, Mobility Stock or the applicable Participating Store may provide relevant information to the applicable Manufacturer or supplier.
The information provided will be limited to what is reasonably necessary to address the applicable request or matter.
Where advertising, analytics, or measurement technologies are used on the Platform, information regarding your browser, device, and interactions with the Platform may be collected or received by the providers of those technologies, as described in our Cookie Policy.
Mobility Stock does not provide those partners with your name, email address, telephone number, or other information that directly identifies you for their own advertising purposes, except with your consent where consent is required by applicable law.

Mobility Stock maintains such information in de-identified form and does not attempt to re-identify it, except as permitted by applicable law.
Mobility Stock may disclose personal information for other purposes with your consent or at your direction, or as otherwise permitted or required by applicable law.
Mobility Stock retains personal information for as long as reasonably necessary for the purposes for which it was collected or as otherwise required or permitted by applicable law, including to:
The length of time personal information is retained may vary depending on the nature of the information, the purpose for which it was collected or processed, applicable legal requirements, and legitimate business needs. Transaction records are generally retained for the period required by applicable tax, product safety, device tracking, and record-keeping requirements, and account information is generally retained while the account remains open and for a reasonable period afterward.
When personal information is no longer reasonably necessary for these purposes, Mobility Stock may delete, de-identify, or otherwise securely dispose of the information in accordance with applicable law and our data retention practices.
Certain information may be retained for longer periods where required or permitted by applicable law or reasonably necessary for legal compliance, fraud prevention, security, dispute resolution, audit, tax, accounting, recordkeeping, or other legitimate business purposes.

An authorized agent may submit a request on your behalf where permitted by applicable law. Mobility Stock may require the agent to provide proof of authorization and may require you to verify your identity directly.
Mobility Stock may request information reasonably necessary to verify your identity and your request before responding, and may request additional information where reasonably necessary to locate the relevant records or process your request.
Mobility Stock will respond to verified privacy requests within the time required by applicable law, generally within forty-five (45) days after receipt, subject to any extension permitted by applicable law.
If Mobility Stock declines to act on your request, we will inform you of the reason. Where applicable law provides a right of appeal, you may appeal that decision within a reasonable period by contacting us using the information provided in Section 15 – Contact Us and identifying the request and the basis for the appeal. Mobility Stock will respond to an appeal within the time required by applicable law and, if the appeal is denied, will provide information about how to contact the applicable state attorney general to submit a complaint.
Where required by applicable law, Mobility Stock will treat an opt-out preference signal sent by your browser or device, such as Global Privacy Control, as a valid request to opt out of targeted advertising and of the "sale" or "sharing" of personal information for that browser or device.
Mobility Stock will not discriminate against you for exercising a privacy right available to you under applicable law.
Certain personal information may not be deleted or otherwise affected by a privacy request where Mobility Stock or another applicable party is permitted or required to retain or process the information, including for purposes such as completing transactions, maintaining business or transaction records, complying with legal obligations, preventing fraud, protecting security, resolving disputes, or establishing, exercising, or defending legal claims.
Certain Platform features, products, or services may also be unavailable if information subject to a request is necessary to provide the applicable feature, product, or service.
A privacy request submitted to Mobility Stock applies to personal information Mobility Stock maintains. If a Participating Store, Manufacturer, or other third party separately maintains personal information about you, you may need to submit a request directly to that party. Mobility Stock will, where required by applicable law, forward a deletion request to service providers and other recipients of your personal information.
Certain state laws regulate "consumer health data," which is defined broadly and may include information that identifies a Customer's past, present, or future physical or mental health status, including information about the purchase of medical equipment or supplies.
Mobility Stock collects the information described in Section 3.4 for the purposes described in Section 5 and discloses it only as described in Section 6. Mobility Stock does not sell consumer health data and will not collect, use, or share consumer health data beyond what is necessary to provide the Platform and the products and services you request, except with the consent required by applicable law.
Where applicable law provides, you may request access to, or deletion of, your consumer health data, and may withdraw consent to its collection or sharing, by contacting Mobility Stock using the information provided in Section 15 – Contact Us.
Mobility Stock uses commercially reasonable administrative, technical, and organizational safeguards designed to protect personal information against unauthorized access, disclosure, alteration, loss, misuse, or destruction.
These safeguards may include access controls, authentication measures, data transmission protections, security monitoring, system and network protections, software and security maintenance, and other measures appropriate to the nature of the information and the Platform.
Although Mobility Stock uses commercially reasonable measures designed to protect personal information, no method of transmitting information over the Internet or storing information electronically is completely secure. Accordingly, Mobility Stock cannot guarantee the absolute security of personal information.
Customers are also responsible for taking reasonable steps to protect their accounts and personal information, including maintaining the confidentiality of their login credentials, protecting their devices from unauthorized access, and promptly notifying Mobility Stock of suspected unauthorized access to or use of their Customer account.
If Mobility Stock becomes aware of a security incident involving personal information, Mobility Stock will investigate and respond to the incident in accordance with applicable law and will provide notifications to affected individuals or to governmental or regulatory authorities where required by applicable law.
The Platform is intended for use by adults. You must be at least eighteen (18) years of age and have the legal capacity to enter into binding agreements to create a Customer account, place an Order, make a Rental Reservation, submit a Service Request, or otherwise enter into a transaction through the Platform.
The Platform is not directed to children under the age of thirteen (13), and Mobility Stock does not knowingly collect personal information from children under the age of thirteen (13) as defined by the Children's Online Privacy Protection Act.
Mobility Stock does not knowingly permit individuals under the age of eighteen (18) to create Customer accounts or independently enter into transactions through the Platform.
A parent, legal guardian, or other authorized adult may use the Platform to purchase Products or request services for the benefit of a minor, provided that the adult is the Customer and is responsible for the account and the applicable transaction.
If Mobility Stock becomes aware that personal information has been provided by a minor in violation of this Privacy Policy or applicable law, Mobility Stock will take reasonable steps to delete the information or otherwise address the matter as appropriate.

The Platform may contain links to third-party websites, applications, products, or services that are not owned or controlled by Mobility Stock. These third-party websites and services operate independently of Mobility Stock and may be governed by their own terms, privacy policies, and practices. The Platform is operated in the United States and is intended for Customers located in the United States. Products are shipped or delivered only to the addresses stated in the Shipping & Delivery Policy.
